The Scottish Ministers make the following Order in exercise of the powers conferred by paragraph 7 of Schedule 1 to the Town and Country Planning (Scotland) Act 1997(1) and all other powers enabling them to do so.
In accordance with paragraph 9 of Schedule 1 to that Act they have consulted South Lanarkshire Council.
1. This Order may be cited as the Town and Country Planning (Continuation in force of South Lanarkshire Local Plan) (Scotland) Order 2012 and comes into force on 29th June 2012.
2. The Scottish Ministers direct that, notwithstanding the adoption of the South Lanarkshire Minerals Local Development Plan(2), the whole provisions of the South Lanarkshire Local Plan(3) shall continue in force to full effect in relation to the area to which the South Lanarkshire Minerals Local Development Plan relates.

This Order continues in force the provisions of the South Lanarkshire Local Plan to full effect in relation to the area to which the South Lanarkshire Minerals Local Development Plan relates. In terms of paragraph 6 of Schedule 1 to the Town and Country Planning (Scotland) Act 1997 the provisions of that local plan would, but for this Order, cease to have effect on the adoption of the South Lanarkshire Minerals Local Development Plan so far as that local plan relates to the area to which the South Lanarkshire Minerals Local Development Plan relates.
1997 c.8. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). Paragraph 7 of Schedule 1 was amended by section 53(7) of the Planning etc. (Scotland) Act 2006 (asp 17).
The proposed South Lanarkshire Minerals Local Development Plan was published and South Lanarkshire Council’s intention to adopt it was advertised on 18th April 2012 in accordance with section 19(10) of the Town and County Planning (Scotland) Act 1997. The proposed plan can be viewed at http://www.southlanarkshire.gov.uk/info/178/local_statutory_development_plans/826/minerals_local_development_plan.
The South Lanarkshire Local Plan was adopted by South Lanarkshire Council on 23rd March 2009. A copy of the plan can be viewed at http://www.southlanarkshire.gov.uk/info/178/local_statutory_development_plans/39/development.plans/2.
