The Scottish Ministers make the following Order in exercise of the powers conferred by section 37(2) of the Water Services etc. (Scotland) Act 2005(1).
Citation and commencement
1. This Order may be cited as the Water Services etc. (Scotland) Act 2005 (Commencement No. 6) Order 2012 and comes into force on 22nd July 2012.
Appointed Day
2. 22nd July 2012 is the day appointed for the coming into force of paragraph 7(5) of schedule 5 to the Water Services etc. (Scotland) Act 2005.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order appoints 22nd July 2012 for the coming into force of paragraph 7(5) of schedule 5 to the Water Services etc. (Scotland) Act 2005 (“the 2005 Act”).
That provision repeals section 40 of the Water Industry (Scotland) Act 2002 (asp 3) (“the 2002 Act”), which empowered the Scottish Ministers to make regulations reducing the charges payable by certain persons under section 37 of that Act. Provision for reduced charges is now made through the Ministers’ statement of policy regarding charges that is issued to Scottish Water and the Water Industry Commission for Scotland under section 29D of the 2002 Act.
