The Human Tissue (Scotland) Act 2006 (Commencement) Order 2006

The Scottish Ministers, in exercise of the powers conferred by section 62(2) and (3) of the Human Tissue (Scotland) Act 2005(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Human Tissue (Scotland) Act 2006 (Commencement) Order 2006.

(2) In this Order “the Act” means the Human Tissue (Scotland) Act 2006.

Appointed days

2.  The provisions of the Act specified in column 1 of the Schedule to this Order and the subject matter of which is described in column 2 of that Schedule shall come into force on 12th May 2006 but, where a particular purpose is specified in relation to any provision in column 3 of that Schedule, that provision shall come into force on that day only for that purpose.

3.  All the provisions of the Act shall, in so far as not then in force, come into force on 1st September 2006.

Explanatory Note

(This note is not part of the Order)

This Order appoints dates for the coming into force of provisions of the Human Tissue (Scotland) Act 2006 (asp 4) (“the Act”). The Act received Royal Assent on 16th March 2006 and sections 52, 59, 60 and 62 came into force on that day.

Article 2 appoints 12th May 2006 as the day for the coming into force of the provisions in the Act specified in the Schedule, but only for a specified purpose or specified purposes.

Article 3 appoints 1st September 2006 as the day for the coming into force of all the provisions of the Act to the extent that they are not already in force at that date.
