The Scottish Ministers, in exercise of the powers conferred by section 21 of the Clean Air Act 1993(1) and of all other powers enabling them in that behalf, being satisfied that the classes of fireplace exempted by this Order can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby make the following Order:
1.—(1) This Order may be cited as the Smoke Control Areas (Exempt Fireplaces) (Scotland) Order 2005 and comes into force on 1st January 2006.
(2) This Order extends to Scotland only.
2. The classes of fireplace described in column 1 of the Schedule to this Order which comply with the conditions specified in relation to each of them in column 2 of that Schedule are exempt from the provisions of section 20 (prohibition on emission of smoke in smoke control area) of the Clean Air Act 1993.
3. In the entry in the Schedule to the Smoke Control Areas (Exempted Fireplaces) (Scotland) Order 1999(2) relating to The Dunsley Yorkshire Stove–
(a)in column 1, for the existing entry substitute–
“The Dunsley Yorkshire Stove, the Dunsley Yorkshire Multifuel Stove and the Dunsley Yorkshire Multifuel Stove and Boiler manufactured by Dunsley Heat Limited”; and
(b)in column 2, after ““A/22160”” insert–
“as amended by the manufacturer’s instructions dated 4th December 2004 bearing the reference “D13” with regard to the Stove and Multifuel Stove and by the manufacturer’s instructions dated 4th October 2004 bearing the reference “GHD/DUN4B/1” with regard to the Multifuel Stove and Boiler”.

(This note is not part of the Order)
This Order, which extends to Scotland only, makes provision for exemption from the prohibition, under section 20 of the Clean Air Act 1993, on the emission of smoke in smoke control areas.
The Order exempts those fireplaces described in column 1 of the Schedule which comply with the conditions specified in column 2 from the prohibitions under section 20 (article 2).
The Order also amends the Smoke Control Areas (Exempted Fireplaces) (Scotland) Order 1999 to extend an existing class description of exempted fireplace and the conditions to be complied with in relation to it.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
