The Additional Support for Learning (Publication of Information) (Scotland) Regulations 2005

The Scottish Ministers, in exercise of the powers conferred by section 26(3) of the Education (Additional Support for Learning) (Scotland) Act 2004(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Additional Support for Learning (Publication of Information) (Scotland) Regulations 2005 and shall come into force on 14th November 2005.

(2) In these Regulations, “the Act” means the Education (Additional Support for Learning) (Scotland) Act 2004.

Further information to be published by education authority

2.—(1) Section 26(2) of the Act shall be amended to the extent that there shall be added, at the end of that subsection–

(g)any Health Board for the area or any part of the area of the authority from which the persons referred to in subsection (2)(f)(i) and (ii) can obtain advice, further information and support in relation to the provision for their additional support needs; and

(h)any other persons which the authority think appropriate from which the persons referred to in subsection (2)(f)(i) and (ii) can obtain advice, further information and support in relation to the provision for such needs, including such support and advocacy as is referred to in section 14..

Timescales within which information to be published

3.  The information to be published by education authorities in relation to the matters specified in section 26(2) of the Act, as amended by these Regulations, shall be published by them within 3 months of section 26 of the Act having been fully commenced.

Form and manner in which information to be published

4.—(1) The information referred to in regulation 3 shall be published by education authorities in the following forms–

(a)in electronic form; and

(b)in printed form,

and shall be held by them in those forms at their head offices and at such public libraries as are located within the area of the education authority, at which places it shall be available for public inspection, without any charge or fee, during normal hours of business of that place.

(2) Such information shall also be provided by education authorities to such persons as may reasonably require that information in another form (whether or not such persons reside within the area of that education authority), in such other form as is reasonably required by them, whether orally or in a form which, by reason of its having some permanence, is capable of being used for subsequent reference (as, for example, an audio or video recording), without any charge or fee, upon being so required.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend section 26(2) of the Education (Additional Support for Learning) (Scotland) Act 2004, to the extent of adding to the matters specified therein, in relation to which education authorities are required to publish information (regulation 2).

They also provide, at regulation 3, for the timescale within which that information is to be published.

Regulation 4 sets out details of the form and manner in which information is to be published.
