Citation and commencement

1.  These Regulations may be cited as the Education (School and Placing Information) (Scotland) Amendment Regulations 2000 and shall come into force on 12th December 2000.

Amendment of the Education (School and Placing Information) (Scotland) Regulations 1982

2.—(1) The Education (School and Placing Information) (Scotland) Regulations 1982(1) are amended in accordance with the following paragraphs.

(2) In regulation 2(1) (interpretation) after the definition of “school year” there shall be inserted the following definition:–

  • “Scottish Credit and Qualifications Framework Levels” mean if any reference in sub-paragraphs (r) and (s) of paragraph 2 of Schedule 1 to these regulations those levels as defined, in the right column of the table immediately below–

(3) Sub-paragraphs (r) and (s) of paragraph 2 of Schedule 1 shall be omitted and there shall be substituted the following sub-paragraphs:–

(r)in the case of a school, other than a special school (not being a special class, or unit, forming part of a school), making provision for pupils in stages S4, S5 or S6, the percentage of pupils in certain stages in each of the three most recent school years attaining certain qualifications and falling into certain categories namely–

(i)the percentage in stage S4 who have accumulated five or more qualifications certificated by the Scottish Qualifications Authority by the end of S4, shown separately as three collective groups of those that attained such certificates at Scottish Credit and Qualifications Framework Level 3 or better, those that attained such certificates at Scottish Credit and Qualifications Framework Level 4 or better and those that attained such certificates at Scottish Credit and Qualifications Level 5 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the school year;

(ii)the percentage in stage S5 who have accumulated one or more qualification certificated by the Scottish Qualifications Authority by the end of S5, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of thepreceding school year;

(iii)the percentage in stage S5 who have ac cumulated three or more qualifications certificated by the Scottish Qualifications Authority by the end of S5, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the preceding school year;

(iv)the percentage in stage S5 who have accumulated five or more qualifications certificated by the Scottish Qualifications Authority by the end of S5, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the preceding school year;

(v)the percentage in stage S6 who have accumulated three or more qualifications certificated by the Scottish Qualifications Authority by the end of S6, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the school year commencing two years previously;

(vi)the percentage in stage S6 who have accumulated five or more qualifications certificated by the Scottish Qualifications Authority by the end of S6, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the school year commencing two years previously;

(vii)the percentage in stage S6 who have accumulated one or more qualifications certificated by the Scottish Qualifications Authority by the end of S6, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 7 or better, the percentage being calculated by reference to the number of pupils in stage S4 as reported in the school census in the first term of the school year commencing two years previously;

(viii)the average figures which correspond to those referred to in heads (i) to (vii) for all such schools situated in the education authority’s area which are under the management of the education authority or which are grant-aided schools, and such average figures for all such schools situated in Scotland which are under the management of an education authority or which are grant-aided schools,

except that where a pupil is presented for a qualification in the same subject at more than one Scottish Credit and Qualifications Framework Level within the same academic year the information of the kind specified in head (i) shall take account only of the highest level attained;

(s)in the case of a special school (not being a special class, or unit, forming part of a school), the number of pupils aged twelve years and over who were in the school in each of the three most recent school years, as reported in the school census in the first term of each of those years, and the number of such pupils in each of those years attaining certain qualifications and falling into certain categories, namely–

(i)the number who have accumulated one or more qualifications certificated by the Scottish Qualifications Authority by the end of each of those school years, shown separately as three collective groups of those that attained such certificates at Scottish Credit and Qualifications Framework Level 3 or better, those that attained such certificates at Scottish Credit and Qualifications Framework Level 4 or better and those that attained such certificates at Scottish Credit and Qualifications Framework Level 5 or better;

(ii)the number who have accumulated one or more qualifications certificated by the Scottish Qualifications Authority by the end of each of those school years, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better;

(iii)the number who have accumulated three or more qualifications certificated by the Scottish Qualifications Authority by the end of each of those school years, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 6 or better;

(iv)the number who have accumulated one or more qualifications certificated by the Scottish Qualifications Authority by the end of each of those school years, shown as a collective group of those that attained such certificates at Scottish Credit and Qualifications Framework Level 7 or better,

except that where a pupil is presented for a qualification in the same subject at more than one Scottish Credit and Qualifications Framework Level within the same academic year the information of the kind specified in head (i) shall take account only of the highest level attained;.

Transitional provision

3.  For the school year 2000/2001 the information required to be published by and the method of publication required by paragraphs 2(r) and (s) of Schedule 1 to the Education (School and Placing Information) (Scotland) Regulations 1982 shall be as follows:–

(a)the qualification results for years 1996/1997-1998/1999 shall be included in the handbooks (using the analyses which existed prior to the coming into force of these Regulations); and

(b)the authority shall ensure that the qualifications results for school year 1999/2000 shall be published and made available free of charge to all parents within 6 weeks of receipt by the school of the required information.
