The Sexual Offences Act 2003 (Notification Requirements) Regulations (Northern Ireland) 2014

Coming into operation in accordance with Regulation 1(2)

The Department of Justice makes the following regulations, in exercise of the powers conferred by sections 83(5) and (5A), 84(1) and (5A), 85(5), 86 and 138(9) of the Sexual Offences Act 2003(1) and now vested in it(2).

In accordance with section 138(6) of that Act, a draft of these Regulations was laid before, and approved by a resolution of, the Assembly.

2003 c.42. Section 83 was amended by section 142(1) of, and paragraph 54(1) of Schedule 26 to, the Criminal Justice and Immigration Act 2008 (c.4). Section 84 was amended by section 142(2) to (5) of the Criminal Justice and Immigration Act 2008. Section 85 was amended by section 142 (6) to (9) of the Criminal Justice and Immigration Act 2008. Section 86 was amended by section 149 of, and Part 4, of the Criminal Justice and Immigration Act 2008.

Section 138 of the Sexual Offences Act 2003 conferred regulation making powers upon the Secretary of State. Article 12 of, and paragraph 77(3) of Schedule 14 to, the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976) inserted subsections (5) to (9) and transferred these powers to the Department of Justice in Northern Ireland.
