The Department of the Environment makes the following Order in exercise of the powers conferred by Article 1(3) of the Road Traffic (Northern Ireland) Order 2007(1).

Citation and interpretation

1.—(1) This Order may be cited as the Road Traffic (2007 Order) (Commencement No.7) Order (Northern Ireland) 2011.

(2) In this Order “the Order” means the Road Traffic (Northern Ireland) Order 2007.

Appointed day

2.  The day appointed for the coming into operation of the provisions of the Order specified in the Schedule shall be 12th September 2011.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation the provisions of the Road Traffic (Northern Ireland) Order 2007 specified in the Schedule as outlined below.

Article 22 inserts a new paragraph (2) into Article 59 of the Road Traffic Offenders (Northern Ireland) Order 1996 (“the Offenders Order”). This new paragraph enables the Department of the Environment (“the Department”) to prescribe graduated amounts for offences. These graduations can take into account the circumstances of a particular offence.

Article 23 amends Article 30 of the Offenders Order to allow the Department to prescribe by Order the appropriate number of penalty points for offences depending on the circumstances.

Paragraph 18 of Schedule 7 substitutes Article 22 of the Offenders Order to allow the certificate issued by the Department to be used as evidence of registration or otherwise as an approved driving instructor.
