Road Traffic (Fixed Penalty) Order (Northern Ireland) 2001

Coming into operation

1st March 2001

The Department of the Environment, in exercise of the power conferred on it by Article 59(a) of the Road Traffic Offenders (Northern Ireland) Order 1996(1), and of every other power enabling it in that behalf, and after consultation with such representative organisations as it thinks fit in accordance with Article 91(1) of that Order, hereby makes the following Order:

Citation, commencement and application

1.—(1) This Order may be cited as the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2001 and shall come into operation on 1st March 2001.

(2) This Order applies in relation to a fixed penalty offence alleged to have been committed on or after 1st March 2001.

Amount of fixed penalty

2.  The fixed penalty for an offence shown in column (1) of the Schedule shall be the amount shown opposite thereto in column (2).

Revocation

3.  The Road Traffic (Fixed Penalty) Order (Northern Ireland) 1997(2) is hereby revoked.

OffenceFixed Penalty
In this Schedule a “fixed penalty offence” is an offence specified in the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997(3).

(a)A fixed penalty offence which does not involve obligatory endorsement;

(b)A fixed penalty offence involving obligatory endorsement;

£60·00

Explanatory Note

(This note is not part of the Order.)

This Order revokes and replaces the Road Traffic (Fixed Penalty) Order (Northern Ireland) 1997. The Order increases the fixed penalties for fixed penalty offences as follows—

(a)the penalty for offences which do not involve obligatory endorsement is increased from £20 to £30; and

(b)the penalty for offences involving obligatory endorsement is increased from £40 to £60.

The Order comes into operation on 1st March 2001 and applies only to offences committed on or after that date.
