The Town and Country Planning (Scotland) Act 1997 is amended as follows.

In section 47 (right to appeal against planning decisions and failure to take such decisions)—

a

in subsection (2), in the closing words, for the words from “such” where it first occurs to the end substitute “the relevant period.”,

b

in subsection (4)(b), for the words from “period” where it first occurs to the end substitute “relevant period”,

c

after subsection (5) insert—

For the purposes of subsection (2), the “relevant period” is—

a

such period as may be prescribed by regulations or a development order, or

b

such other period as may be agreed in writing between the applicant and the authority in respect of the application (whether before or after it is made).
