98Temporary disapplication of section 97

Section 97 does not apply in relation to regulations under section 32 or 34 that are brought forward before the date specified by the Scottish Commission on Social Security.

The Commission specifies a date under subsection (1) by giving written notice to—
a
the Scottish Ministers, and
b
the Scottish Parliament,
informing them of the date from which the Commission will be ready to perform its function of scrutinising legislative proposals in accordance with section 97.

In subsection (1), “brought forward” means contained in a draft Scottish statutory instrument that is laid before the Scottish Parliament for approval by resolution.

At any time after the date specified by the Commission under subsection (1), the Scottish Ministers may by regulations repeal this section.
