21Inquiry to be conducted in public

Inquiry proceedings are to be conducted in public.

But the sheriff may order that such proceedings (or any part of them) are to be conducted in private.

The sheriff may make an order under subsection (2)—
a
on the sheriff’s own initiative, or
b
on the application of the procurator fiscal or a participant in the inquiry.
