SCHEDULE 2Scottish statutory instruments: transitional and consequential provision

1Interpretation

In this schedule—

  • “devolved Scottish public authority” means an authority to which paragraph 1 or 2 of Part 3 of Schedule 5 to the Scotland Act1998 (c. 46) applies (Scottish public authorities with mixed or no reserved functions), and

  • “pre-commencement enactment” means an enactment passed or made before Part 2 comes into force.

A reference in this schedule to a function’s being exercisable within devolved competence is to be construed in accordance with section 54 of the Scotland Act1998 (c. 46).

For the purpose of the definition of “pre-commencement enactment” in sub-paragraph (1), an Act of the Scottish Parliament is to be taken to have been passed on the date on which the Bill for the Act was passed by the Parliament.
