Chapter 7 SAssaulting or impeding employees and others

39 Assaulting or impeding employees discharging certain functions S

(1) A person who assaults, obstructs or hinders another person who is—

(a) an employee of [F1 SFRS]; and

(b) discharging any of the functions conferred on [F2 SFRS] under section 8, 17 or 61,

commits an offence.

(2) A person who assaults, obstructs or hinders another person who is providing assistance to [F3 SFRS] under arrangements made by virtue of section 35 for the purpose of the carrying out by [F4 SFRS] of any of the functions conferred on it by virtue of section 8 or 61 commits an offence.

(3) A person who assaults, obstructs or hinders another person who is by virtue of section 36 carrying out a function conferred on [F5 SFRS] by virtue of section 8 or 61 commits an offence.

(4) A person guilty of an offence under this section shall be liable on summary conviction to imprisonment for a period not exceeding [F6 12] months or to a fine not exceeding level 4 on the standard scale [F7 or to both].
