Section 8 and schedule 4 – Excluded matters
40.Subsection (1) of section 8provides that the Ombudsman must not investigate any matter specified in schedule 4. Schedule 4 contains absolute exclusions as opposed to the restrictions on investigations and conditions that have to be satisfied which are set out in the body of section 7. Subsection (2)provides for Her Majesty, by Order in Council, to modify, add or remove matters specified in schedule 4.
