59 General principlesS

(1)The Scottish Ministers F1... and the Council shall exercise their functions under this Act in accordance with the principles set out in the following subsections.

(2)The safety and welfare of all persons who use, or are eligible to use, care services are to be protected and enhanced.

(3)The independence of those persons is to be promoted.

(4)Diversity in the provision of care services is to be promoted with a view to those persons being afforded choice.

[F2(5)In subsection (2), “care service” means a care service as defined in section 47(1) of the Public Services Reform (Scotland) Act 2010 (asp 8).]
