51 Confirmation of orders

A charging scheme shall not come into force unless the order making it has been submitted to and confirmed by the Scottish Ministers; and a variation or revocation of such a charging scheme shall not take effect until the order making the variation or revocation has been so submitted and confirmed.

Subsection (1) above shall not apply in such circumstances as may be specified in, or determined in accordance with, regulations made by the Scottish Ministers.

Where confirmation of an order is required by this section, the order may be confirmed by the Scottish Ministers—
a
in the form in which it is submitted; or
b
subject to such modifications as they may specify.
