WHEREAS it is desirable to substitute the Scheme set out in the Schedule to this Act (in this Act called “the 1954 Scheme” ) for the Scheme confirmed by the Vaughan's Charity (Administration) Act (Northern Ireland), 1936 [1936 c.24] :

And Whereas the 1954 Scheme has been approved by Her Majesty's Attorney General for Northern Ireland, the Trustees of the Vaughan Agricultural Institute and the Ministries of Finance, Agriculture and Education for Northern Ireland:

And Whereas it is necessary for giving effect to the 1954 Scheme that an Act passed in the fifteenth and sixteenth years of the reign of His Majesty King George the Third, chapter thirty-eight, relating to the Vaughan's charity (among other things), (in this Act referred to as “the Act of the Irish Parliament”) should, so far as it relates to the said charity, have effect subject to the provisions of the 1954 Scheme:

And Whereas it is necessary, for the purpose of giving effect to the 1954 Scheme, to make such further provision in that behalf as is hereafter contained in this Act:

1Future administration of Vaughan Agricultural Institute.N.I.

(1)As from the commencement of this Act the Vaughan Agricultural Institute shall be administered in accordance with and subject to the provisions of the 1954 Scheme.

(2)The 1954 Scheme shall have effect as if enacted in this Act.

(3)The Act of the Irish Parliament shall, so far as it relates to the Vaughan Agricultural Institute, have effect subject to the provisions of the 1954 Scheme.

2Repeals, etc.N.I.

(1)The Act of 1936 is hereby repealed without prejudice to anything done or suffered thereunder or to any right, title, privilege, obligation or liability acquired, accrued or incurred thereunder.

(2)Any document made or issued at any time (whether before or after the passing of this Act) which refers to the Scheme confirmed by the Act of 1936 or any provision of that Scheme shall, unless the contrary intention appears, be construed as referring to the 1954 Scheme or, as the case may be, to the corresponding provision of the 1954 Scheme.

(3)Any person holding office or acting or serving under or by virtue of any provision of the Scheme confirmed by the Act of 1936 shall, unless the contrary intention appears, continue to hold his office or to act or serve as if he had been appointed or authorised under or by virtue of the corresponding provision of the 1954 Scheme.

(4)The inclusion in this section of any express saving or other provision shall not be taken to prejudice the operation of section thirty-eight of the Interpretation Act, 1889F1 [1889 c.63] , as it applies to repeals effected by Acts of the Parliament of Northern Ireland.

3Short title.N.I.

(1)This Act may be cited as the Vaughan's Charity (Administration) Act (Northern Ireland), 1954.
