1Restriction on legal proceedings in respect of accidental fires.N.I.

(1)No legal proceedings shall be instituted against any person in or on whose building or land any fire has (whether before or after the passing of this Act) accidentally begun, in respect of damage caused by reason of such fire:

Provided that this provision shall not be construed as affecting the institution of legal proceedings—

(a)against any person for damage caused by negligence or by bringing a dangerous thing into or upon a building or land occupied by him; or

(b)for the enforcement of any contract or of any covenant or agreement contained in a lease or letting of a building or land.

(2)In this section the expression “building” includes any structure of whatever material constructed or for whatever purpose used, and the expression “lease” includes a grant in perpetuity.
