2Troseddau

(1)Mae’n drosedd i berson sy’n fanwerthwr alcohol—

(a)cyflenwi alcohol o fangre gymhwysol yng Nghymru, neu

(b)awdurdodi cyflenwi alcohol o fangre gymhwysol yng Nghymru,

am bris gwerthu sy’n is na’r isafbris cymwys am yr alcohol.

(2)Mae’n amddiffyniad i berson sydd wedi ei gyhuddo o drosedd o dan yr adran hon ddangos i’r person gymryd camau rhesymol ac arfer diwydrwydd dyladwy i osgoi ei chyflawni.

(3)Os yw person sydd wedi ei gyhuddo o drosedd o dan yr adran hon yn dibynnu ar yr amddiffyniad yn is-adran (2), ac y dygir tystiolaeth sy’n ddigonol i godi mater mewn cysylltiad â’r amddiffyniad hwnnw, rhaid i’r llys gymryd bod yr amddiffyniad wedi ei fodloni oni bai bod yr erlyniad yn profi y tu hwnt i amheuaeth resymol nad yw wedi ei fodloni.

(4)Mae’n amherthnasol at ddibenion is-adran (1)(b) a yw’r awdurdodiad yn digwydd yng Nghymru neu yn rhywle arall.

(5)At ddibenion yr adran hon ac adran 6, ystyr “pris gwerthu”, mewn perthynas ag alcohol, yw ei bris gan gynnwys TAW a phob treth arall.

(6)Yn Atodlen 4 (trwydded bersonol: troseddau perthnasol) i Ddeddf 2003, ar ôl paragraff 2 mewnosoder—

“2AAn offence under the Public Health (Minimum Price for Alcohol) (Wales) Act 2018.”
